| 摘 要： | 我国现有关于涉外合同法律适用的立法内容主要是存在于1999年10月1日生效的《中国人民共和国合同法》中,其中意思自治原则的适用、最密切联系原则的适用及国际条约的适用存在着有待解决的系列问题。对此,应结合目前国内一些新的立法观念和国际立法趋势制定出与我国现阶段整体立法、司法相适应的新补充性规定或单行法规。

| Abstract: | Our present application of law of contracts concerning foreign affairs exists mainly in"contract law of the people's Republic of china",which is put into effect on October 1,1999.There is still a series of problems which is urgent to solve,such as the application of self-administration principle,the closest relation principle and the application of international treaty.Therefore,we should develop new supplementary stipulations or single regulations,combined with new domestic legislative ideas and international legislative tendency. |
