| 摘 要： | 竞技致损行为"排除犯罪性"事由不限于"正当化事由",而应包括阻却构成要件事由、阻却违法事由、阻却责任事由3类,以适应竞技致损行为的不同情况.对抗性竞技轻伤行为,可因"被害人承诺"阻却构成要件该当性;非对抗性竞技伤亡行为,可因"自赴风险"阻却构成要件该当性;对抗性竞技(重)伤亡行为,若未犯规,可因"正当业务行为"阻却违法性;若犯规,仍可能因欠缺责任能力、故意过失或期待可能性而阻却、减轻责任.
