| 摘 要： | "虚拟主体"是指以TCP/IP协议为基础在互联网上虚构、假设的网络行为的实施者.在处理网络争端的过程中,人们提出:虚拟空间中虚拟的"人"能否人格化,从而成为法律"人"?通过对法律人格内涵、标准的分析发现,虽然法律人格在现代社会呈现扩张的趋势,但赋予"虚拟主体"法律人格的设想没有法律上的进路."虚拟主体"是民事主体在网络环境下的身份,它代表了不同的现实主体在网络活动中不同的地位并体现了他们的特定的利益.

| Abstract: | "The virtual subject" is the executor of the fictitious or hypothetic network acts on the base of TCP/IP contracts.In the course of settling the network disputes,it's brought forward that whether "the virtual person" in the virtual space can be personalize so as to be "the legal person".By the analysis of the connotation and standard of the legal personality,we find that legal personality presents the tendency towards expanding in the modern society,but the tentative plan to give the virtual subject the legal personality has no way in the law."The virtual subject" is the status of the civil subject in the network.It stands for the different status of the different real subjects in the network activities and embodies their specific interests. |
