| 摘 要： | 教育权是教育法研究的核心。教育权可从广义与狭义、主体与客体等层面分别定位为国家教育权、社会教育权、公民教育权。教育权的横向分配和纵向分配都有不同模式。我国教育权分配模式的现实选择,既有其根据也有其问题,需要在改革中完善。

| Abstract: | The education right is at the core of the study of the education law.The education right may be defined broadly or narrowly as the state,public or individual citizen's education right respectively.There are different hierarchical layers in the allocation of the education right.While the reasonable practices in the allocation of the education right in China should be upheld,problems must be corrected in the process of reform. |
