| 摘 要： | 传统法行为是现代法行为的渊源,我国传统法行为模式的特征表现为:与礼行为的关系上,法行为具有附属性;儒家伦理的原则支配和规范着法的发展,成为立法与司法的指导思想,这就是传统法行为的伦理性;在法行为内容上体现了不平等性;法行为的心理机制表现为“恶法”、“忍讼”、“厌讼”;法行为的根本价值取向为“无讼”。因此,传统法行为模式与现代法行为的要求有差距,建立现代法治国家必须正视这一特征。

| Abstract: | The traditional law behavior is the origin of modern law behavior. The features of traditional Chinese law behavior mode turn up in various ways: law behavior has subsidiary quality compared with rite behavior. Confucius' moral principles dominate and standardize the development of law behavior, and act as its guiding ideology, which is the ethical quality of traditional law behavior. The content of law behavior reflects inequality and undefined quality of behavior mode. The psychological mechanism of law behavior finds expression in "detesting laws" and shows manifestation in "bearing lawsuits" and in "becoming weary of lawsuits". The basic value orientation of law behavior is "no lawsuits". Therefore, there is a gap between traditional law behavior modes and modern law behavior requirements. We must face it squarely in the process of governing the state by law. |
