| 摘 要： | 全国人大常委会对《侵权责任法（草案）》已完成了三次审议，但从法工委起草的《草案》和学者提出的建议稿来看，我国侵权立法中要如何规定网络侵权尚远未达成共识。网络侵权应采以主体为类型化标准；网络侵权类型中的主体，其侵权规则应已较成熟，且排除与《侵权责任法》一般性规定中规则相同的内容，也要排除只适用于特定侵权客体，可通过民事特别法加以规定的情形。在立法编排中，网络侵权类型应通过以主体为编排标准作出集中规定。
