| 摘 要： | 人格权的权利属性,即人格权到底是一种民法权利还是宪法权利,在法学界一直存在争议。通过对法国、德国法中对人格权规定的分析,分别从宪法的本质、宪法与民法之间的关系和目前我国宪法的司法适用情况,探讨人格权的权利属性问题。最终得出人格权是民法权利的一种,需要通过民法来加以规范和保护的结论。

| Abstract: | What kind of right the personality right is,i.e.civil right or constitution right,is a controversial issue in legal circles.By analyzing such questions as regulations of personality in French law and German law,the essence of constitution,the relationship between constitution and civil law,and the judicial application of constitution in China,we come to a conclusion that personality right is a kind of civil right and it should be regulated and protected by civil law. |
