| 摘 要： | 在我国,行政主体因其违法行政行为给相对人的合法权益造成损失的,可以通过行政赔偿制度予以救济;而其合法行使权力的行为如果侵犯相对人的权益则可以通过行政补偿予以解决,这已成为一种共识。对于行政赔偿,《国家赔偿法》已作了较为细致的规定,但对于补偿制度却缺乏统一的规定,甚至行政补偿还只是法律术语。在理论和实务上,长期以来都未对行政补偿制度给予足够的重视,对行政补偿基本原则的研究也极少,本文将通过对域外各国行政补偿基本原则的介绍来反思我国的行政补偿制度,以期推动行政补偿制度的发展。

| Abstract: | In China, the government carl protect the citizen＇s right through administrative reparation system when violating the citizen＇s right for the government＇s fault deeds, at the same time, the government can protect the citizen＇ s right through administrative system when violating the citizen＇ s right for the government＇ s legal deeds. This is consensus. The state compensation law has made detailed roles to administative reparation system, but there is no provision to administrative compensation system. It is lack of attenti to administrative compensation system in practice and theory. It is also lack of research in the basic principle of administative compensation. This article will reflection the administrative compensation through introducing the basic pinciple of administative compensation in other countries, in order to promote the administrative compensation system of our country. |
