| 摘 要： | 对罪刑均衡的历史性考察实际上是对罪刑关系的解读,作为一种思想观念的确立,最早可追溯到原始社会的同态复 仇,但是作为一项基本原则,罪刑均衡又依托于广博的理论学说,由理论观点的差异必然导致罪刑均衡价值观的流变。通过对罪刑 均衡的历史性考察,分析罪刑均衡的兴与衰以及不同学派所蕴含的不同的价值观。

| Abstract: | The historical study of balance between crime and punishment is in fact an interpretation of the relationship between crime and punishment. As a kind of ideas, it can be traced back to the retaliation with similar nature of the primitive society. But as a fundamental, it also relys on extensive theories. The difference among theoretic opinions inevitably results in the charge of the values of balance between crime and punishment |
