| 摘 要： | 随着信息技术的不断发展,"互联网+经济"模式成为社会经济发展的重要引擎,同时也使得劳动关系呈现出灵活化及多样化的趋势,各类新型网络用工形式不断涌现,网约工规模也在不断扩大。但目前网约工劳动关系确认困难,司法实践中同案不同判现象频发以及网约工劳动保障体制的欠缺,使得网约工的权益保障陷入困境。为了使网约工劳动权益得到保障,进而促进互联网经济的有序发展,应首先构建劳动关系认定的"三分法"模式,其次统一网约工劳动关系认定的裁判思路,最后完善网约工劳动权益的保障机制,具体从强化网络平台方的责任,完善政府监督和社会保障工作两方面入手。

| Abstract: | With the continuous development of information technology, the “Internet+economy” model has become an important engine for social and economic development. At the same time, it also makes labor relations show a trend of flexibility and diversification. Various new forms of online laborers continue to emerge, and the scale of online laborers is also expanding. However, the current difficulty in identifying labor relations of online laborers, the frequent occurrence of different judgments in the same case in judicial practice, and the lack of a labor security system for online laborers have caused the protection of online laborers’ rights and interests to be in a difficult situation. In order to protect the labor rights and interests of online laborers and promote the orderly development of the Internet economy, the “trichotomy model” for labor relations identification should be constructed first, and then the judging ideas for labor relations identification for online laborers should be unified, and finally online laborers should be improved. The protection mechanism of labor rights and interests specifically starts with strengthening the responsibilities of the network platform and improving government supervision and social security work. |
