| 摘 要： | 新型案件的增加本属正常的社会现象和法律现象,但行政机关不作为的国家赔偿案件却引起审判机关在司法实践中的过多争议,表现为不作为是否需要赔偿、如何赔偿、举证责任如何承担等问题的不同观点,致使法官对法律的适用及案件结果的不统一.

| Abstract: | In practical judicial affairs,a new series of geneal legal phenomenon causes heated dispute in judicial organs,that is the national compensation for unacted cases concerning administrative units.There are various concepts about unacted cases,such as whether needs to compensation,how to compensate,and how to bear the responsibility for offering evidences.As a result,it may be led to different results about legal application and suitable cases. |
