| 摘 要： | 本通过对现实中存在的一些问题进行分析归纳，指出我国目前法治建设中需要引起重视的几个问题，并提出了相关的解决措施。本结合我国具体情况，具有针对性。本重点强调两方面：法律的合法性与个案衡平；法治渠道的畅通与法律利雏坦。本认为引入衡平法精神，尤其符合我国现状，并提出了人性分析角度是法治研究中需要引起重视的问题。

Several Thinkings on Present Condition about Rule of Law |

| Abstract: | This text, through analyzing some questions existing in reality, points out several questions about rule of law paid attention to under our country law construction and puts forward relevant settlement measures. This essay bases on the real conditions of our country, so it is pointed. This text emphasizes two respects especially: The legitimacy of the law and weighing apparatus of the case;the good law channel and the supreme status of law. This text thinks that introducing the chancery law spirit is necessary to the current situation of our country and puts forward the idiom that the analysis of human nature is very important in the research on rule of law. |
