| 摘 要： | 当前 ,我国国有企业股份制改革中出现的产权问题主要是由以下原因引起的 :一是由于国有资产产权没有明确的界定 ,导致国有资产和国有股的权益受到严重的损害 ;二是在股份制改革中 ,出现产权界定不清的“企业股” ;三是股东权益得不到明确界定和有效保护 ;四是股份制企业的股票 (特别是国有股 )难以上市交易。综合起来看 ,国有企业股份制改革中产权问题的出现是由于没有先进行产权的界定引起的

| Abstract: | This paper analyses the property rights problems arisen in the reform of the state-owned enterprises: 1)the state-owned assets and stocks are damaged badly due to the ambiguously defined property rights; 2) the enterprise-owned stocks can be defined clearly in the stock system reform; 3) the rights of the shareholders can be defined clearly and protected effectively; 4) the stocks of the stock company (especially the state-owned stocks) can be exchanged in the stock market. To sum up, the author renders that the property rights problems arisen in the reform of the state-owned enterprises are the consequences of the absence of the clear defining of the property rights. |
