| 摘 要： | 格式合同的产生是市场经济高度发达的结果,但格式合同却不可避免的造成合同双方地位的不平等,影响合同自由的实现。为了尽量消除格式合同的弊端,合理地平衡当事人之间的权利义务关系,应该对格式合同采取立法规制、行政规制、司法规制以及社会规制等手段进行综合调整,才能使格式合同制度更好的为社会服务。这对促进我国社会主义市场经济建设健康有序的发展具有重要的意义。

| Abstract: | The formation of format contract is the result of the highly developed market economy,but format contract inevitably makes the the position of Parties of Contract unequal,which goes against the freedom of contract.In order to eliminate deficiencies of format contract and balance the right and obligation of both parties,it is necessary to make legislative,judiciary,administrative and self-disciplined control on the format contract.So format contract system can better serve the society and this is very important to promote the healthy development of market economy. |
