| 摘 要： | 债权人代位权是新《合同法》规定的保护债权人合法权益的重要制度,它的确立为解决现实生活中的“三角债”问题提供了法律依据。本文阐述了代位权制度在诉讼适用中的一些基本问题,希望在实践中对正确处理有关代位权案件有所帮助。
