| 摘 要： | 从法律法规角度出发,结合职业足球联赛的具体情况,分析探讨了中国足协、裁判身份的法律性质及裁判与中国足协的关系。结果表明：职业足球裁判在代表中国足协履行裁判工作职责期间属于国家工作人员;职业足球裁判“黑哨”行为不属于商业贿赂。对其以公司、企业人员受贿罪论处不恰当;我国相关法律在竞技体育领域中存在空白和漏洞,应进一步加强立法工作。

| Abstract: | On the legal liability viewpoint combining football theory with practice in the character of the law among referee and the football association of China. To conclusions: It is belong to the person-nel of state when football referee working for the football association of China i there is no merit for de-termining the act of "black whistle" as the business organization accepting bribes. It is important to en-hance legislation power for the legal provistons remain on balance some loopholes in athletics of China. |
