| 摘 要： | 本文首先界定了网络服务商的定义．认为网络服务商主要指为网络提供信息传播中间服务的主体，即网络中间服务商，而不包括本身就是独立主体的网络内容提供商。在此基础上。研究了网络服务商的责任形式，主要应以过错责任为主，按权利义务相一致的原则承担相应义务。文章最后讨论了我国立法对网络中间服务商的责任的限制。

| Abstract: | ISP,who plays a very important role in the internet transfer,is the backbone of the on line information transmission.The development of the internet includes lots of contents as well as the management and using manner of the ISP.As a result,ISP may bear legal responsibility in a broad range.The major problem this paper will shed light on is the tort liability of ISP.The ISP who supplying infrastructure neither makes any infringed information nor attaches itself directly to infringement should bear liability,that is,the issue of the indirect infringement liability.This related question will be given a preliminary study in this paper. |
