| 摘 要： | 人是生产关系中最活跃的因素，人在经济发展中占越来越重要的地位。教育是提高人的素质、增加人力资本存量最直接的也是最有效的方法之一，然而中国农村职业教育总体状况令人堪忧，这直接影响了农村经济的发展。资金投入不足、带有身份性质的户籍制度以及教育举办主体的权义不明是制约中国农村职业教育发展的三大重要因素。为了促进农村职业教育的发展，繁荣农村经济，建设社会主义新农村，立法应注意明确教育举办主体的权利、义务和责任，协调教育管理体制扣分税制，改革户籍制度。同时，为鼓励全社会参与农村职业教育，实现政府职能的转变，应充分发挥“促进型立法”在发展农村职业教育中的作用。

| Abstract: | Man is the most active factor in productive relations,and Man occupies more and more important status in economic development. Education is one of the most effective methods to improve Man ＇s quality and increase the quantity of human capital storage. However,the condition of rural vocational education in China is bad,which has a direct impact on rural economic development. The lack of fund, the discriminatory household registration system,and unclear rights restrict the development of rural vocational education. In order to promote the development of rural vocational education,promote economic prosperity in the country,and build the new socialist countryside, the legislation should pay attention to define the right,duty and responsibility of the subject,coordinate the relation beteen the education ad- ministration system and the tax distribution system, reform discriminatory household registration system. Meanwhile, in order to encourage all the social members to participate rural vocational education and transform government＇s function, ＂promotion legislation＂ should be brought into play to develop rural vocational education. |
