| 摘 要： | 自两高三部委发布的两个规定以来,非法证据排除规则一直是人们的焦点,而新修改的刑事诉讼法的相关规定。对相关规定的出台喝彩的同时,大部分人表示悲观——＂缩小非法证据的范畴＂、＂相关配套制度不完善＂、＂对非法物证的排除规定过于模糊＂,学者们从各个角度剖析了我国现有非法证据排除规则的瑕疵。

| Abstract: | Since the Two Principles had been issued by Supreme Court,Supreme People＇s Procuratorate and Three Ministers,the exclusion rules of illegal evidences have been the focus of attention.Some of us showed the support to some relevant rules in newly-revised criminal procedure law,and most of us expressed a pessimistic outlook,such as reducing the category of illegal evidences,imperfect supporting systems and dim exclusion rules of illegal evidence.Scholars,from many aspects,discusses the flaws in exclusion rules of illegal evidence in China. |
