| 摘 要： | 循环型社会就是通过转变社会意识形态以及社会生产模式、消费模式,抑制自然资源的消费和废弃物的排放、减轻环境负荷,从而达到环境和社会经济发展双赢的可持续发展的社会形态。环境正义是循环型社会的基本法律价值。循环型社会的法律制度特征是:以可持续发展为指导思想,以系统共生性、政府协调性和义务本位为特点,以循环经济法为核心内容。我国循环型社会法律体系的设计应当首先从制定《循环型社会促进基本法》开始。

| Abstract: | Circular society is defined as a sustainable social formation balancing the environmental and economic development, which is achieved by transforming social ideology as well as productive and consumed patterns, reducing the consumption of natural resources and the emission of waste, and lessening the environmental burden. Environmental justice is the fundamental legal spirit of the circular society. In terms of legal regulations, the defining features of a circular society include: the guiding principle of sustainable development, the characteristics of systematic symbiosis, governmental coordination and universal obligation, and the core content of circular economic law. The design of China's legal system of a circular society should begin with the enactment of Promotion of Circular Society Fundamental Law. |
