摘    要:最高人民法院于2003年4月28日公布的《关于审理商品房买卖合同纠纷适用法律若干问题的解释》中明确规定房地产开发企业在商品房合同纠纷中如有法条中所规定的五种欺诈行为,将承担惩罚性赔偿责任。虽然,《解释》的公布解决和填补了房地产法律的某些空白,保护了广大购房者的权利,但是,《解释》在某些方面仍然显得仓促和不严谨,并非购房者的“保护神”。文章在《解释》对惩罚性赔偿适用的规定上,提出了值得商榷的几个问题。

Abstract:On April 28,2003,the Supreme People's Court declared the law:"Explanations About the Law Applied to Some Issues in Contract Dispute of Commodity Apartment" in which five cases are considered as cheating,and real estate corporations have take responsibility of compensation.Although the law fills in the blanks in this field,there are some problems for further discussion considering the rush law making.
