| 摘 要： | 在多元化纠纷解决机制的发展潮流中，司法ADR具有降低当事人诉讼成本，节约国家司法资源，减少当事人诉讼对抗的价值和功能。自20世纪70年代以来，司法ADR在国际上逐渐兴起并成为司法程序内解决纠纷的新方式。对美国、日本和我国台湾地区法院附设调解制度进行比较分析的基础上，以现行法院调解制度的改革为契机，就我国法院附设调解制度的构建予以探讨。

| Abstract: | In the development of diversified dispute settlement mechanism, Court annexed ADR has such thnctions as reducing Litigan costs, saving judicial resources, reduceing parties＇ confrontation. Since 1970s, Court annexed ADR gradually rised and became a new method of judicial process in America. From compared and analysed attached mediation of court with America, Japan and Taiwan region, meanwhile the author discusses attached mediation of court in China, hopes that it will be beneficial to China＇ s Judicial ADR. |
