| 摘 要： | 调解与判决是相互独立、相互影响的两种处理案件方式，二者各有优势，不能相互替代。只有在现有法律制度框架内，对一些具体制度加以修订完善，在此基础上，将调解与判决结合，因势利导，才能增强人民法院的司法审判能力，更好地化解社会矛盾。
