| 摘 要： | 目前,我国对软件的保护适用著作权法,同时颁布《计算机软件保护条例》进行具体保护,还针对软件的特性,修改了《专利法》、《专利法实施细则》和《专利法审查指南》。我国未来软件立法应以版权法保护为基础,既避免法律保护模式选择上的转型,也符合目前国际形势,使我国软件较易取得国际保护。
