| 摘 要： | 我国法学界长期以来仅关注人身与财产等民事权益，而忽视对环境本身所遭受损害的研究，且传统侵权法无法解决环境损害的赔偿问题，因此有必要研究和确立环境损害赔偿制度，以应对日益严重的环境问题。环境损害赔偿权利人是建立环境损害赔偿制度首要解决的问题之一。从理论上分析，可将环境损害赔偿权利人分为三类：环境行政机关、公民个人和环保团体。模式构造可以参照《欧盟环境责任白皮书》的建议，将环境行政机关作为首要赔偿权利人，公民个人或环保团体作为补充在立法中加以确立。

| Abstract: | In China, the law circle has concentrated on the research on the civil rights and interests of person and property but neglected the research on the damage of the environment itself. In addition, the traditional tort law is unable to solve the compensation of environmental damage. Thus, it is necessary to do research in and set up the system of compensation of environ- mental damage in order to deal with the increasingly serious environmental problem. The obtigee for the compensation of environ- mental damage is one of the problems that need to be solved immediately for setting up the system of compensation of environmen- tal damage. According to the theoretical analysis, the obligee for the compensation of environmental damage can be divided into three categories： environmental administrative agencies, citizens and organizations of environmental protection. As to the construction of mode, the advice in the White Paper on Environmental Liability of EU can be acted on, which sets up environmental agencies for the primary obligee for compensation, citizens and organizations of environmental protection as supplement in the legislation. |
