| 摘 要： | 在发生高楼不明抛掷物致人损害时，为了分散损失，维护受害者的利益和整个社会的安宁，通过保险的方式提供救济有积极意义，但也有其自身的弊端，保险救济方式不是最佳的方式；将高楼不明抛掷物致人损害的问题完全脱离侵权法的框架，交由社会保障的途径予以救济，则过于理想化，忽视了社会保障机制本身存在着的无法解决的难题；物业管理人承担责任是过错责任，是有条件的，不能作为处理不明抛掷物致人损害责任的一般原则；侵权法规范不明抛掷物致人损害责任有必要性。

| Abstract: | In order to disperse the damages caused by unknown tossed objects, maintain the casualties＇ interests and social peace, it has positive significance to get remedy by ways of social insurance. However, because of the weakness of itself, the way of social insurance is not the best one. It is so ideal that getting remedy by the way of social security just leaves the tort law away. There are some conditions where property management enterprises take the responsibility. It can not become the general way to deal with the case. Tort Law is still necessary. |
