| 摘 要： | 从信任结构理论的角度看,传统中国是一个人格信任的社会,由此决定了适用于其中的法律的伦理化品性。只有对这些特点有了明确的把握以后,在中国社会与法律的现代化转型中,我们才能获得更为明晰的前进方向和出路：建立系统信任为主导的社会结构和形式化的法律制度。
