| 摘 要： | 多数国家采用制订国内立法来实施提单统一公约。并对公约国内立法为这些规定不是忽视了对本国货主利益的保障,就是忽视了公约所要求的国际统一。笔者还注意到法律适用的统一性及合理解决各国在统一公约基础上的法律冲突之必要,主张运用冲突规范实施统一公约,并对如何运用冲突规范实施统一公约提出了具体方法。

| Abstract: | Most conntries have implemented the uniform conven-tion for bills of lading by mun cipal legislation which also provides itsscope of application, i.e., the boundary rule. On the basis of a studyof various boundary rules, this paper points out that this rule failseither to protect consignees of its own country or to promote inter-national uniformity which the convention pursues. It is held that to solvethe conflicts among nations in applying the uniform convention, theconflict rules may be carried out to ensure its proper application. Thepaper finally offers some concrete proposals as to how to use the con-flict rules. |
