| 摘 要： | 公平与正义是人类社会的基本原则,也是彩票生存与发展的价值基础。本文从彩票游戏的本质和功能出发,着重讨论了彩票起点上的机会公平,即平等的购买权利、较低的进入门槛、均等的中奖机会;过程中的程序正义,规则公平是前提,信息公开是关键,救济渠道通畅是保障;以及结果上的分配正义,彩票是否增进了社会福利,彩票公益金应该如何使用,彩票所得该不该缴税。

| Abstract: | The equity and justice are not only the basic principle of human society,but also the value foundation of the existence and development of lottery.Proceeding from essence and function of lottery game,this article analyzes the chance equity of lottery at the start,which refers to the equal buying right,less entrance limitation and equal opportunity to win prize.The paper also focuses on the procedure justice of the process,including equal rules,open information and clear compensation channels.The last important point of the article is the distribution justice of the results: whether lottery promotes the growth of social welfare or not,how to use the public welfare fund of lottery,and whether tax on lottery income should be paid or not. |
