| 摘 要： | 本文通过对民法上的侵权行为归责原则的内涵和著作权侵权行为的分类研究,提出著作权侵权归责的总原则是以过错责任原则为基本原则,以及一定条件下的过错推定归责方式的适用这样的归责原则体系。

| Abstract: | Based on the definition of the liability principle and a classified analysis of the infringement copyright,the paper points out that the doctrine of dual liability criterion with copyright is only related with the liability to pay compensation.It is necessary to adopt the doctrine of dual liability criterion,i.e.fault liability and presumed fault liability.In consequence,it is not adapted to adopt the Non-neligence liability. |
