| 摘 要： | 一边是国内电视节目市场愈演愈烈的＂克隆＂风,一边是寻求对其电视节目版式进行保护的栏目组屡屡碰壁。造成这种现象的主要原因在于受到思想表达二分法的阻碍,电视节目版式迟迟无法得到《著作权法》保护。然而,被版权界视为＂神话＂的思想表达二分法,并非无懈可击,电视节目版式符合作品认定的实质和形式要件,理应得到《著作权法》的保护。
