| 摘 要： | 一直以来法学界对我国是否实行沉默权制度存在着分歧。笔者认为从法律权利的角度来看,实行沉默权制度有利于权利主体充分自主地行使自己的权利。这不但有利保护人权也有利于促进侦察水平的提高。

| Abstract: | The law field has always disagreed on whether or not the silent right will be carried out in our country. I think ,from the angle of lawful rights, that carrying out the system of the silent right will favour the right subject's exercising his own rights efficiently and independently. This is good for not only protecting human rights but also promoting reconnaissance level. |
