| 摘 要： | 假释是一项历史悠久的刑罚执行制度,它有着深厚的理论底蕴,是刑事近代学派主观主义、特别预防主义、教育刑理论在刑罚执行制度上的体现。假释制度与刑法中的人身危险性理论有着密切的联系。在法律全球化、行刑社会化、刑罚轻缓化的全球背景之下,假释对于刑罚制度的完善具有极大的价值。

| Abstract: | Parole,as an execution of punishment system of long history,has profound theoretical elements,which is the expression of subjectivism,doctrine of special defence,educational theory of modern school criminal affairs in the execution of punishment system.Parole system is closely connected with personal danger theory of Criminal Law.Parole system is of great value to improve penalty system when law is globalized,penalty execution is socialized and penalty is towards being lighter and sustained. |
