| 摘 要： | 刑法规范是规定犯罪及其责任的法规范。刑法规范既是行为规范，又是责任规范；既是禁止规范，又是命令规范；既是假设规范，又是评价规范；既是制裁规范，又是裁判规范。刑法规范的机能不同于刑法机能，它包括评价机能和决定机能，是评价机能和决定机能的有机统一。

| Abstract: | Criminal norm refers to the norm which prescribes crimes and its responsibities.It is the norm of conduct and responsible norm,the prohibitive norm and commanding norm,the assumptional norm and evaluating norm,the sanctional norm and judicial norm.The functions of criminal norm differs from the functions of criminal law.It contains evaluating function and decisive function,that they are organic unities. |
