| 摘 要： | 自由选择作为现代社会的中心价值,因其是契约经济实现以及契约和法规约束下自由意志实现的前提,以 目标取向的中国经济体制改革,需大力培养平等、自由等契约观念,认识经济运行中自由、契约、法律三者关系,确立“法律的目的不是废除或限制自由,而是保护和扩大自由”信念,将自由选择作为一种长期的价值选择和追求。

| Abstract: | As the essence of modern society,free choice is the premise of the realization of both contract economy and free determination that is controled by contracts and law.Chinese reform of economic system,aiming at founding the system of market economy,needs contract notions such as fair.freedom to be developed;The relation between freedom,contract and law in the course of economic operation should be correctly realized;The notion--"The aim of law is not to abolish or limit freedom,on the contrary,it is to protect and widen freedom" needs to be established.Free choice also need to be regarded as the choice of value in the long run. |
