| 摘 要： | 劳动争议发生的原因在于人民调解协议不具有强制性,而这也正是人民调解协议效力在实践中的困境。只有正确认识人民调解协议不具有强制性的原因以及并对人民调解协议的本质、现代市民社会追求确定性原则的需求、现有人民调解协议司法确认制度进行反思,才能找到对人民调解协议效力的完善措施。

| Abstract: | This paper analyzes the labor dispute empirical cases because the agreement of people mediation is not mandatory,which is also the practical problem of people’s mediation agreement.The paper discusses the reasons and nature of the people’s mediation agreements,the demand that modern civil pursue the certainty principle,and the reflection on the existing judicial confirmation system of people mediation agreement.The paper puts forward the suggestions on people’s mediation agreement force to perfect it. |
