| 摘 要： | 随着国际交往的逐渐频繁和通讯手段的日益发达,国际贸易也越来越多的借助于网络这一平台,这一交易形式的改变也使得电子签章在电子商务中取代了传统的手写签字,成为决定合同是否生效的重要因素之一。我国于2005年4月颁布实施了第一部《中华人们共和国电子签名法》,第一次在法律上赋予了电子签章的法律效力。本文将简单分析国际贸易中电子签章的基本概念、特征、适用范围及其法律效力。

| Abstract: | During the development of international intercourse,the international trades are more and more with the aid of internet.This change of form makes electronic signature take the place of hands signature,which becomes one of the important elements to affect whether the contract is effective or not.Our country implemented the first "The Electronic Signature Law of People's Republic of China" in April 2005,and this endows electronic signature the legal effect for the first time.This article plans to simply analyze the basic concept,feature,applicability and legal effectiveness of electronic signature in international intercourse. |
