| 摘 要： | 非营利组织设立的依据是宪法保护的结社自由,结社自由并不否定国家对非营利组织的管理。综合考量,各国对非营利组织的管理,在认知上存在两种基本的逻辑:权利本位或自由的逻辑,义务本位或管制的逻辑;在实践上存在两种基本的进路:行为的进路和组织的进路。不论政府对非营利组织发展采取何种态度,非营利组织管理大体上采取两种模式:统一综合管理模式和目的事业管理模式。

| Abstract: | Freedom of association,as a constitutional right,is the base of NPO.Freedom of association itself is not in conflict with the supervision of the government.Generally speaking,there exist two fundamental logic,i.e.right-based or freedom logic and duty-based or controlling logic,and two fundamental styles,conduct and organization,concerning the supervision of NPO.No matter what the government’s attitude is toward the development of NPO,there are two modes of supervising NPO:unified and comprehensive mode as well as respective mode concerning the specific nature of individual NPO. |
