| 摘 要： | 纵观人类刑罚史,刑罚的人道性是人类刑罚发展的动力与方向,死刑作为人类历史上最严厉的刑罚经历了由兴盛到衰亡的发展过程。近年来国际社会反对死刑的呼声渐高,很多国家废除了死刑。本文就死刑的价值、废除死刑的基础进行探讨,以从理论上澄清废除死刑是人类文明前进的方向以及中国所面临的现实选择。

| Abstract: | Humanism is the motivity and direction of penalty's development. As the cruelest penalty, capital punishment experienced the period from nourishment to decline. Recently, there are more and more oppositions to capital punishment in the whole world. capital punishment has been abolished in many countries. In order to prove that abolishing capital punishment is the direction of human civilization, we discussed capital punishment's value and the basis of its abolishment. |
