| 摘 要： | 2011年2月25日，《中华人民共和国刑法修正案（八）》在全国人大常委会第十九次会议中获得高票通过，并于2011年5月1日起施行，其中最引人注目的是增加了“危险驾驶罪”这一新的罪名。但“危险驾驶罪”立法仍存在缺陷，如对危险驾驶行为的界定过于狭窄，情节界定比较模糊，在法定刑方面只规定了基本犯．而对于危险驾驶造成危害后果者没有涉及。因此，我们应通过司法解释补充危险驾驶罪罪状、合理设置危险驾驶罪的主刑以及其他法律设定柔性惩罚措施来实现立法完善。

| Abstract: | In February 25, 2011, ＂PRC Criminal Law Amendment （eighth） ＂ at the nineteenth meeting of the NPC Standing Com- mittee was passed, and in force since May 1, 2011, one of the most attract sb＇s attention is the addition of ＂dangerous driving＂ in this new charge. But the ＂dangerous driving crime＂ legislation has defects, such as the definition of dangerous driving behavior is too nar- row, the plot with vague definition, in legal punishment only provides basic crime, and for dangerous driving causing harmful conse- quences are not involved. Therefore, we should supplement by judicial interpretation of crime of dangerous driving, reasonable arrangement of dangerous driving crime punishment and other legal punishment setting flexible measures to realize the perfection of legislation. |
