| 摘 要： | 黑格尔国家和法的思想受到了德国古典哲学的深刻影响，认为国家先于社会和家庭产生，认为法的本质是自由意志的结合，国家是主观意志和客观意志的统一。黑格尔国家和法思想具有抽象性、阶级狭隘性和社会永恒性。马克思对黑格尔国家和法思想存在的抽象性、狭隘和永恒性问题进行了深刻批判，并形成了自己独有的国家观和法哲学。当今中国国家的建设和法律体系的构建与完善仍然需要不断研究马克思的国家和法的思想。

| Abstract: | Hegel’s thoughts of state and the law was deeply affected by German classical philosophy, which thought that state prior to the society and the family, that the essence of the law was the combination of free will, and the state was the unity of subjective and objective will. Hagel’s thoughts of state and law is abstract, social class and social permanence. Marx deeply criticizes the abstract, narrow and eternal questions of Hagel’s state and law thoughts, and forms his own unique view of state and law. In today’s China, the construction and improvement of the legal system still need to continue to study the idea of Marx ’s state and law. |
