| 摘 要： | 现行政体下，全国人大及其常委会是监督宪法实施的唯一主体，这种体制保证了我国最高权力机关行使监督宪法实施的职权，但在理论和实践上存在着许多不足和缺陷，弥补的最佳方法是创设宪法法院作为宪法监督的另一主体。两个主体各司宪法监督的不同职责并相互监督，将构建起具有中国特色的宪法监督体制。

| Abstract: | In the present political structure, the National People's Congress as well as its Standing Committee is the only subject to supervise the implementation of the constitution. This arrangement guarantees the function and power of the supreme organ of state power to supervise the implementation of the constitution, but in theory and practice, it has many drawbacks. The best way to make up is to create a Constitution Court as another subject to supervise the implementation of the constitution. Thus the two subjects will carry out their different duties in supervising the implementation of the constitution and meanwhile supervise each other. They will constitute the mechanism of supervision by constitution of Chinese characteristics. |
