| 摘 要： | 职业体育作为一项特殊的产业,具有不同于一般社会经济活动的特殊性,其参与者之间既相互竞争又在许多方面维持着特殊垄断的两面性,引发了诸多不同于其他经济领域的新问题,需要法律制度专门的调整,以适应职业体育的特殊要求。伴随着我国经济体制转轨所产生和发展起来的职业体育,行政垄断色彩浓厚,应依法予以禁止,而对于经济性垄断,则应区别情况,分别纳入反垄断法的豁免制度和规制范围。

| Abstract: | The professional sports as a special industry has its own feature comparing to the others economic action.It has dual character,not only need competition,but also keep monopolization in many aspect.This character brings to many new problems which need to be adjusted by special legal system.Adapting with the social and economic reforms,the professional sports of our country has been emerged and developed,but the administrative monopoly is outstanding and should be ban according the law.As for the economic monopoly should think about difference condition,give it exemption or regulation according anti-monopoly law. |
