| 摘 要： | 现今社会中,知识产权作为一种无形资产越来越受到人们的重视,商号权作为知识产权的一个组成部分急需法律的调整和规范。我国还没有建立起专门的商号权法律保护制度,只能在现行反不正当竞争法的框架下切实保护商号权。因此,不但要求我们要正确认识商号权的概念、性质、法律特征及内容,而且还要了解我国商号权法律保护的现状,掌握解决商号权与商标权及其他权利冲突的原则。

| Abstract: | Today in our society,as an valuable intangible property,intellectual property is being paid more and more attention on.and the right of trade name,as an composition of the intellectual property,is urgent to be controlled and adjusted by law.At present there is not a domestic law protecting the right of traditional name of a shop directly,and we have to protect the right of trade name under the framework of actual anti-unfair competition law.So it is our duty that we should not only know the conception,the nature,the legal characteristics and the contents of the right of trade name correctly,but also understand the actuality of the legal protection on the right of trade name and master the principles of settling the conflicts between the right of trade name and other rights. |
