| 摘 要： | 代位权作为我国合同法上规定的对债权人实现债权的一种权利救济方式,目前已越来越多地运用于市场经济民事活动中。本文从权利人行使代位权的角度出发,对诉讼的公平性和可操作性、诉讼管辖、诉讼标的,债务人在代位权诉讼中的诉讼地位等主要法律问题进行了阐述,以期能对代位权诉讼有一较为完整的认识。

| Abstract: | Subrogation is our contract law provided for the creditors to claim a right of relief,being now increasingly used market economy civilian activities.This article from the right exercise subrogation rights perspective, relying on the "law of contract interpretation," the theory of civil law,by exploring nature of subrogation litigation,litigation fairness and operability,expounds major legal issues about subrogation litigation,for example the jurisdiction of the proceedings,the subject of proceedings,the debtor's status in subrogation litigation proceedings and Influence of the similar case to the afterwards of the adjudication of the past,with a view to have a comparatively intact understanding to the subrogation litigation proceedings. |
