| 摘 要： | 通过文献资料法，从体育法学的原始资料中整理出不同时期关于体育法地位的不同观点，梳理对体育法地位研究的学术成果，分析归纳出我国关于体育法地位的几种学说并指出它们的不足之处。进而认为，体育法是独立部门法，因为原有的法律部门划分标准是调整对象加调整方法，由于调整对象比较空泛，或者说，不好界定，所以辅之以调整方法。现在要改变这种情况，而应更加强调调整对象，弱化调整方法，并且对调整对象重新定义。 |

| Abstract: | In this paper,the authors review different theories and academic achievements about sports law's position during different periods,and analyzed several theories and their flaws about sports law's position in China.In the final the conclusion is drawn: the sports law is the law of independent department and give out the reasons. |
