| 摘 要： | 劳务派遣对缓解我国就业压力起到了重要作用，但由于其法律关系区别于传统劳动关系，具有“三方主体、关系复杂”的特点，各方权利和义务的界定一致是学术界研究的热点。文章通过建立“派方与要方成本分担均衡模型”和“试错博弈均衡模型”，分析了劳务派遣市场的均衡及其实现过程，并得出政府确定保障成本、政府与派遣方和要派方三者持续博弈和试错是实现劳动者权益最大化的两个条件。在模型分析基础上，提出了建设“四位一体”劳务派遣市场的构想和策略。

| Abstract: | Worker Dispatch has been playing a very important role in reducing the pressure of employment. However, because of the difference between Worker Dispatch and traditional labor relation, Worker Dispatch has some special feature. In this article, the authors make an analysis of the equilibrium of labor market and the process through two complicated models firstly, then, draw the conclusion that certain security cost and the game of the three partners are the two preconditions to maximize the interests of the labor. Finally, the authors advance some strategy to form a Worker Dispatch market of four partners . |
