| 摘 要： | 继承是一种重要的文化现象,同时也是一项古老的法律制度.继承制度的产生与发展,都与其社会历史文化背景息息相关,不同社会条件下形成的继承制度犹如是年代久远的传统文化宝藏,都值得人们去发掘探寻.比较我国唐代与古罗马的继承制度,两者存在既有共性又相区别的形式.在继承内容上,唐代以身份继承为主,而古罗马是以身份继承发展至财产继承.在继承方式上,我国唐代继承制度以法定继承为主,而古罗马继承制度是以遗嘱继承为主.在继承主体上,我国唐代女子继承权受限,而古罗马继承制度中继承权男女平等,因此研究这两种不同的继承制度有深远的意义.
