| 摘 要： | 《中华人民共和国行政诉讼法》颁布17年来，行政审判的司法环境大为改善，“民告官”的积极性不断提高，官应诉的自觉性不断增强。2004年3月，国务院《全面推进依法行政实施纲要》出台后，全国各地相继推行行政首长出庭应诉制度。然而，在司法实践中，由于认识上的不一，制度上的欠缺，各地行政首长出庭应诉工作开展得还很不平衡．亟需进一步构建完善。

| Abstract: | Since the issue of Administrative Procedural Law of the People＇s Republic of China 17 years ago, judicial environment for administrative trial has been improved greatly, specifically, the zeal for the ordinary people to bring a lawsuit against the officials and the consciousness for the officials to respond to it have been enhanced. After the issue of the Guidance to Overall Promotion of Administration According to Laws by the State Council in March of 2004, the system of asking the administrative head to respond to the lawsuit has been put into practice in different regions of China. However, in the judicial practice, because of the different understandings and the deficiency in the system, this kind of practice has not been followed well, which should be improved further. |
