| 摘 要： | 合理使用制度著作权构建了著作权法利益平衡机制。随着网络普及,网络作品的出现,著作权法的利益平衡机制被打破。技术的发展削弱了权利人对作品的控制,技术保护措施应运而生,合理使用制度在网络领域遭遇了新的挑战。所以必须对合理使用制度作出调整,如扩大合理使用制度的适用范围,统一其适用的界定标准及对技术保护措施进行立法上的限制,等等,以适应网络技术给合理使用制度所带来的新问题。

| Abstract: | Rational use of the copyright law system and copyright work together to build a balanced mechanism for the interests of copyright law.With the spreading of the network and the appearing of the network works,the balance of the mechanism is broken.Technological development has weakened the control of right holders on their works,so the technical protection measures come into being.The rational use of the system in the network area has been challenged,so the system should be adjusted,for example,to expand the scope of its application,define the uniform standards and restrict technical protection measures so as to solve the problems. |
